9) Damaged, Missing, or Incorrect Items

Please inspect items as soon as possible after delivery. If something arrives damaged, missing, or not as expected:

Arbitration Agreement and Class Action Waiver (Risk-Safe Version)

1) Agreement to Arbitrate

You and Foter agree that any dispute, claim, or controversy arising out of or relating to these terms, your purchase, your use of the site, or the relationship between you and Foter will be resolved by binding individual arbitration, rather than in court, except as noted below.

2) Exceptions

  • Bringing an individual action in small claims court, if eligible
  • Seeking injunctive or equitable relief in court for alleged unlawful use of intellectual property or unauthorized access to the site

3) No Class Actions

You and Foter agree that disputes will be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve the individual claim.

4) Arbitration Provider and Rules

The arbitration will be administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, as modified by this agreement.

5) Location and Remote Hearings

Arbitration may be conducted by telephone, video, or based on written submissions, unless an in-person hearing is required by the arbitrator. If an in-person hearing is required, it will take place in New York County, New York, unless the parties agree otherwise.

6) Fees and Costs

Payment of filing, administration, and arbitrator fees will be governed by the AAA rules and applicable law. Each party will bear its own attorneys' fees and costs unless the arbitrator awards fees under applicable law.

7) Batch Arbitration (Mass Arbitration Management)

If 25 or more similar demands for arbitration are filed against Foter by the same or coordinated counsel, the parties agree to group the arbitrations into batches and resolve them in a structured process intended to reduce costs, including selecting a small number of cases as initial bellwether proceedings and pausing the remaining cases while bellwethers proceed. The arbitrator will have authority to implement a fair batching process consistent with this section and the AAA rules.

8) Opt-Out Right

You may opt out of this arbitration agreement within 30 days of first accepting these terms by emailing [email protected] with your name, the email address used for your account or order, and a clear statement that you want to opt out of arbitration.

9) Severability

If any part of this arbitration agreement is found unenforceable, the remainder will remain in effect. If the class action waiver is found unenforceable, then the arbitration agreement will not apply to that dispute.
